1. Agreement & Acceptance

By using or accessing GoalCrush (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, you must not use the Service.

2. Eligibility

You must be at least 18 in India (or the minimum legal age in your country) to use the Service. By using this platform, you confirm that you meet this requirement.

Age Verification: We may request age verification at any time. Providing false age information may result in account termination.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities under your account.
• You agree to provide accurate information and not impersonate others.
• Account Security: You must immediately notify us of any unauthorized use of your account.

4. Subscription & Payment Terms

4.1 Pricing and Billing

• Subscription Plans: GoalCrush offers various subscription plans with different features and pricing tiers. Current pricing is displayed on our platform and may vary by region.
• Plan Details: Details of the features, storage limits, access rights, and group limitations associated with each plan (including Free and Premium tiers) are provided on our Cancellation Policy page, which forms part of these Terms.
• Billing Frequency: Subscriptions are billed on a recurring basis (monthly, quarterly, or annually) depending on the plan you select.
• Payment Methods: We accept various payment methods including credit cards, debit cards, and other digital payment options as displayed at checkout.
• Currency: All prices are listed in Indian Rupees (INR) unless otherwise specified for your region.

4.2 Automatic Renewal

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
• Renewal Charges: Your payment method will be charged automatically at the beginning of each renewal period at the then-current subscription rate.
• Price Changes: We reserve the right to modify subscription pricing. You will be notified at least 30 days before any price change takes effect for existing subscribers.
• Renewal Notifications: We will send you a reminder notification prior to each automatic renewal.

4.3 Free Trials and Promotional Offers

• Trial Periods: We may offer free trial periods for new subscribers. Trial terms and duration will be clearly stated at sign-up.
• Trial Conversion: Unless you cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the standard rate.
• Trial Eligibility: Free trials are typically limited to one per user and may require valid payment information.
• Promotional Offers: Special pricing, discounts, or promotional offers may be available from time to time. These offers are subject to specific terms and conditions, which will be communicated at the time of the promotion.
• Promotion Limitations: Promotional offers cannot be combined unless explicitly stated and may have eligibility restrictions.

4.4 Cancellation and Refund Policy

Important: For complete details on cancellations, refunds, plan downgrades, and feature limitations, please review our separate Cancellation Policy. The following is a summary:

• How to Cancel: Contact our support team at goalcrushofficial@gmail.com with your account information and subscription details.
• Cancel Before Renewal: To avoid being charged for the next billing cycle, you must cancel before your renewal date.
• Processing Time: Cancellation requests are processed within 3-6 business days. Submit your request well in advance of your billing date.
• No Refunds: All subscription fees are non-refundable. Once a billing cycle has been charged, refunds are not provided.
• Exceptions: Refund requests may be reviewed on a case-by-case basis at our sole discretion for exceptional circumstances (technical issues, billing errors, etc.), but approval is not guaranteed.
• Access After Cancellation: Premium features remain active until the end of your current billing period. After that, your account will be downgraded to a Free account with a 7-day grace period to manage groups.
• Subscription Non-Renewal: If you do not renew your Premium subscription, your account will be automatically downgraded to a Free account with a 5-group limit. See our Cancellation Policy for full details on the downgrade process and grace period.
• Cancellation Confirmation: You will receive a confirmation email once your cancellation has been processed.

Consumer Rights: Nothing in this policy affects your statutory rights as a consumer under applicable law.

4.5 Payment Authorization and Failures

• Payment Authorization: By providing payment information, you authorize us to charge the applicable fees to your payment method.
• Failed Payments: If a payment fails, we may attempt to process the payment again. You are responsible for ensuring your payment information remains current and valid.
• Account Suspension: Failure to pay subscription fees may result in suspension or termination of your account and loss of access to premium features.
• Outstanding Balances: You remain responsible for any outstanding amounts owed, and we may pursue collection of such amounts.

4.6 Taxes

• Tax Responsibility: You are responsible for any applicable taxes (including GST, VAT, or sales tax) related to your subscription, unless we are required to collect such taxes.
• Tax Collection: Where required by law, we will collect and remit applicable taxes on your behalf.

5. User Content & Conduct

You own the content you post, but grant us a non-exclusive license to use, display, reproduce, modify, distribute such content for operating and promoting the Service.

• You will not post illegal, defamatory, abusive, spam, or infringing content.
• We reserve the right (but not the obligation) to remove content or suspend accounts that violate rules or these Terms.
• Content Moderation: We may use automated systems and human review to monitor content for policy violations.
• Reporting: Users may report inappropriate content through our reporting mechanisms.

6. Copyright / IP

• Respect copyright and intellectual property laws.
• If you believe your copyrights have been infringed, you may send a takedown request to us (contact info below). We will respond accordingly.

• Website Materials: Our platform contains material owned by or licensed to us, including design, layout, appearance, graphics, and content. Reproduction is prohibited except in accordance with copyright notices.
• Trademarks: All trademarks displayed on our platform that are not our property are acknowledged and remain the property of their respective owners.
• Unauthorized Use: Unauthorized use of information or materials from our platform may give rise to claims for damages and/or constitute a criminal offense.

7. Disclaimers & Limitations of Liability

• The Service is provided "as is," without warranties of any kind.
• No Warranties: Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of information and materials on our platform for any particular purpose.
• Performance Disclaimer: We make no warranties regarding the reliability, availability, or performance of our services.
• We are not responsible for content generated by users.
• In no event shall we be liable for indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service.
• You acknowledge that information and materials on our platform may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies to the fullest extent permitted by law.
• Your use of any information or materials on our platform is entirely at your own risk, for which we shall not be liable. It is your responsibility to ensure our services meet your specific requirements.

The content, features, and functionality of our platform are subject to change without notice. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notification.

10. Payment Issues

We shall not be liable for any loss or damage arising from declined payment authorizations due to preset limits or restrictions by your bank or payment provider.

• Transaction Limitations: We shall not be liable for any loss or damage arising from declined transactions due to preset limits agreed with financial institutions.
• Card/Payment Limits: Users acknowledge that payment limitations may apply based on agreements between us and payment processors.
• Banking Restrictions: We are not responsible for any restrictions, limits, or policies imposed by your bank or financial institution that may affect transactions.

11. Termination

• You may delete your account at any time.
• We may suspend or terminate your access for violations of these Terms or for any reason, without prior notice.
• Upon termination, your rights under these Terms end, but certain provisions (liability, IP, etc.) survive.

12. Governing Law

• These Terms are governed by the laws of India and subject to the jurisdiction of the courts in Gujarat, India.
• Any disputes will be subject to the courts in that jurisdiction.

13. Force Majeure

We shall not be liable for any delay or failure in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, internet outages, or government actions.

14. Indemnification

You agree to indemnify and hold harmless GoalCrush, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

16. Entire Agreement

These Terms constitute the entire agreement between you and GoalCrush regarding the Service and supersede all prior agreements and understandings.

17. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

19. Changes to Terms

• We may modify these Terms from time to time.
• If changes are material, we will provide notice (via email or platform notification). Continued use after changes means you accept them.
